TERMS AND CONDITIONS FOR TRANSLATION SERVICES

Terminology:

The Language Corner is used to refer to The Language Corner Limited.

“The Client” is used to refer to the individual /company commissioning The Language Corner Limited’s services.

“The Translator” is used to refer to the individual providing a translation in the normal course of business as per the instruction of The Language Corner Limited.

Translation is used to mean the preparation of a translation or any other translation-related task such as revising, editing and proofreading but not copywriting or adaptation.

Copyright in Source Material, and Translation Rights:

The Language Corner Limited accepts an order from The Client on the understanding that performance of the translation task will not infringe any third party rights.

The Client undertakes to keep The Language Corner Limited and/or The Translator harmless from any claim for infringement of copyright and/or other intellectual property rights in all cases.

The Client likewise undertakes to keep The Language Corner Limited and/or The Translator harmless from any legal action, including but not limited to defamation, which may arise as a result of the content of the original source material or its translation.

Completion and Return:

The Language Corner Limited is a professional language company. We aim to please our clients and provide an efficient service. Every effort will be made to return completed, translated documents to the client within the agreed timescale. However, The Language Corner Limited shall not be liable for any consequential losses as a result of delay in returning a completed translation.

Confidentiality:

No documents for translation shall be deemed to be confidential unless this is expressly stated by The Client. However, The Language Corner Limited and The Translator shall at all times exercise due discretion in respect of disclosure to any Third Party of any information contained in The Client’s original documents or the translations thereof without the express authorisation of The Client. Nevertheless, a third party may be consulted over specific translation terminology queries, provided that there is no disclosure of confidential material. The Translator shall be responsible for the safekeeping of The Client’s documents and copies of the translations and shall ensure their secure disposal.

Cancellation:

If a translation task is commissioned and subsequently cancelled, reduced in scope, or frustrated by an act or omission on the part of The Client or any third party, The Client shall pay the full contract sum unless otherwise agreed in advance.

Provision of documents for translation:

The Client is responsible for checking the document(s) before sending for translation, in order to ensure that there are no omissions or errors. A refund will not be made should the Client notice an omission or error in the original file after the job has been placed with the translator.

Liability:

A translation shall be fit for its stated purpose and target readership and the level of quality specified. Unless specified otherwise, translations shall be deemed to be required to be of “for information” quality only. The liability of The Language Corner Limited shall be limited to the sum paid for the translation.

In the case of certified translations, The Language Corner Limited (and/or our suppliers) are ultimately responsible for the translated text and have absolute discretion to reject any change requested by the Client which the accredited translator feels isn’t a true and accurate reflection of the original text. No refund will be issued if we reject a Client’s change request in these circumstances.

Miscellaneous: This agreement shall be governed and construed in accordance with the Laws of England and shall be subject to the exclusive jurisdiction of the Court of England.

Satisfaction with Services:

Any discrepancies must be highlighted within 5 days upon receipt of the translation, otherwise it is considered to be accurate. Discrepancies must be submitted in a manner that accurately demonstrates the nature of the complaint.
